for taking up the matter on an earlier date.

Learned counsel appearing for the respondent Municipal Corporation of Delhi (“MCD”) has drawn the attention of this Court to the various Status Reports which are on record, to submit that the requisite action has been taken time and again, against the unauthorised construction existing on the subject property.

He further draws the attention of this Court to the latest Status Report/Action Taken Report filed on behalf of the MCD, wherein, it has been stated as follows:

That it is submitted that pursuant to demolition/sealing orders already passed in respect of the identified subject property i.e. bearing No. C-14, Opp. C-15, Paryavaran Complex, New Delhi, the Building Department -II of South Zone-MCD has taken/carried out the necessary sealing action on pre-fixed date i.e. 30/04/2026 and upon availability of police force, 01 big hall at Ground floor has been sealed at 04 points. The photographs taken during the aforesaid sealing action are annexed herewith as Annexure -A (Colly).

That after taking the aforesaid sealing action, a letter dated 06/05/2026 has also been sent to concerned, SHOPS Mehrauli, New Delhi with the request to keep strict watch and ward over the subject property so that the seals affixed by the department may not be tampered with. Copy of the said letter dated 06/05/2026 is also annexed herewith as Annexure -B .

That further, so as to ascertain the latest/present status of the subject property, the same has been got inspected through area field staff of Building Department -II of South Zone - MCD and it has been noticed that the earlier seals affixed by the department on 30/04/2026 were found tampered with. Taking note of the same, the necessary proceedings for lodging of an FIR has been initiated/ processed against the violators/offenders.

8. That the department has now fixed the further necessary action programme in respect of the subject property for 04/08/2026 which

will be taken/carried out upon availability of police force. xxx xxx xxx”

Learned counsel appearing for respondent-MCD submits that in terms of the aforesaid Status Report, further action was also taken on 04^th August, 2026. In addition, he submits that in case if there is any other action required, the same shall also be taken.

Accordingly, the MCD is held bound by the aforesaid statement.

Noting the aforesaid, no further directions are required to be passed in the present petition.

¶27

However, in case, the respondent no. 1 is aggrieved by any action being taken by the MCD, the respondent no. 1 is at liberty to seek remedies in accordance with law.

Therefore, the present petition is accordingly, disposed of.

Pending applications also stand disposed of.

The next date of hearing of 28^th October, 2026, stands cancelled.
