Learned counsel appearing for the petitioner draws the attention of this Court to the judgment of the Supreme Court, in the case of Dhananjay Rathi Versus Ruchika Rathi, 2026 SCC OnLine SC 587, wherein, it has been held as follows:

Learned counsel appearing for the petitioner submits that the compliance in terms of the serial nos. 7 and 8 of the table, as given above, in the judgment needs to be done by the respondent.

He submits that the aforesaid table contains the compliances in terms of the Memorandum of Understanding (“MoU”) dated 16^th May, 2024 duly

executed between the parties, terms of which, are reproduced as under:

Learned counsel appearing for the petitioner submits that the respondent is required to comply with the terms of the aforesaid MoU, particularly, the terms at serial nos. 1, 2, 4, 5 and 6.

At this stage, learned counsel appearing for the respondent submits that the respondent shall cooperate in the execution of the gift deed as well as relinquishment deed, without prejudice to right of the respondent to file a curative petition before the Supreme Court.

He submits that the premium for life insurance of the respondent is in Aditya Birla Capital, that has been fully paid and the petitioner herein is the nominee of the respondent in the said life insurance.

He submits that the respondent would like to change the nominee, instead of the petitioner, so that the children would become the nominee. 8. Learned counsel appearing for the petitioner submits that he has no objection if the respondent retains the life insurance policy of Aditya Birla Capital, and changes the nominee from the petitioner to the children.

Accordingly, the aforesaid statement is taken note of. 10. The parties are directed to cooperate with each other in changing the nominee of the aforesaid life insurance policy of Aditya Birla Capital from petitioner to the children.

This Court notes the submission made by learned counsel appearing for the petitioner that a Life Insurance Corporation (“LIC”) Policy, bearing No . 117410693 has matured.

He submits that the amounts upon maturity of the said policy, have been taken by the respondent, and the said amounts need to be transferred to the petitioner.

Learned counsel appearing for the respondent, after some hearing, has agreed to transfer of the amount of Rs. 27,82,500/- (Rupees Twenty-Seven Lacs Eighty-Two Thousand Five Hundred Only) of the LIC Policy, as

aforesaid, to the account of the petitioner.

The aforesaid statement is also taken note of. Let the needful be done by the respondent, within a period of one week, from today. 15. Attention of this Court has also been drawn to paragraph 55(vi) of the said judgment of the Supreme Court, which reads as under:

Reading of the aforesaid clearly shows that the Supreme Court has directed that the amount of Rs. 89,00,000/- (Rupees Eighty-Nine Lacs Only), as deposited by the respondent herein before this Court, shall be returned to the respondent along with interest accrued on the said amount. 17. Accordingly, the respondent/authorized nominee of the respondent is granted liberty to approach the Registry of this Court for the purpose of return of the said amount.

Upon such application being made, the Registry shall return the amount of Rs. 89,00,000/- (Rupees Eighty-Nine Lacs Only) to the respondent along with the interest accrued on the said amount.

This Court also takes note of the submission made by learned counsel appearing for the respondent that certain personal articles of the respondent are lying in the house of the petitioner, for which a message has already been given to the petitioner.

Learned counsel appearing for the petitioner, on instructions, submits that the said articles of the respondent shall be returned back to her.

Let the needful be done, within a period of two weeks.

Both the parties are held bound by the statements and directions as noted aforesaid.
