The present petition has been filed alleging wilful disobedience of the judgment dated 20^th August, 2025, passed by the Division Bench of this Court in W.P. (C) 1317/2008 , wherein, it was directed as follows:

Accordingly, we dispose of this petition by directing the petitioners to consider the case of the respondents by holding Review DPC for the vacancies that were available from the year 1999 to year 2002, that is, prior to the amendment in the recruitment rules. In case the respondents are found eligible and entitled for promotion, consequential orders in that regard shall be passed granting consequential benefits to the respondents. The entire

exercise must be completed by the petitioners within a period of 12 months from today”.

Perusal of the aforesaid judgment passed by the Division Bench clearly shows that the only direction to the respondent was to hold a review Departmental Promotional Committee (“DPC”) for the vacancies that were available from the year 1999 to 2002. Further, in case, the petitioners herein were found eligible and entitled for promotion, consequential orders in that regard were directed to be passed.

Pursuant to the aforesaid order passed by the Division Bench, an order dated 02^nd February, 2026, has come to be passed by the Department of Agriculture & Farmers Welfare, Ministry of Agriculture & Farmers Welfare, Government of India, wherein, it has been held as follows:

Perusal of the order dated 02^nd February, 2026, passed by the Ministry of Agriculture & Farmers Welfare, Government of India shows that the review DPC was held. However, the petitioners herein have not been held to be eligible for promotion, in the grade of Research Investigators.

Accordingly, in case, the petitioners are aggrieved by the said order passed by the Ministry of Agriculture & Farmers Welfare, Government of India, the petitioners are at liberty to challenge the same in accordance with law.

Noting the aforesaid, the present petition is disposed of.
