Through the present petition, the petitioner seeks setting aside the impugned order dated 22.04.2026 passed by the learned Civil Judge-01 (Shahdara) KKD Courts, Delhi, in Civil Suit No.83/2022, where the learned Trial Court has closed the petitioner’s right (defendant therein) to lead evidence for the reason that he is deliberately not pursuing the case.

Learned counsel for the petitioner, while relying on the annexed medical reports which indicate that the petitioner was suffering from low blood pressure on 21.04.2026 and 22.04.2026, requests that one last and final opportunity may be granted to the petitioner to lead evidence.

The learned counsel for the petitioner further submits that the closure of the petitioner’s right to lead evidence, which will adversely effect the petitioner’s rights is disproportionate considering that there were several
