The limited grievance of the petitioners is with regard to the expeditious and time-bound disposal of Execution Petition No. 493/2022, titled “ Harjinder Singh vs. Virender Pal Singh & Anr. ”, pending before the learned Additional District Judge, West District, Tiz Hazari Courts, Delhi. 2. The pending execution proceedings originate from the underlying suit for declaration, filed by the Respondent No. 2, before this Court, in CS (OS) No. 181/2010, titled “Mr. Gurmeet Singh v. Mr. Harjinder Singh & Ors.” 3. Learned single bench of this Court, vide consent decree dated 08.10.2015, granted the Petitioners, therein, Defendant No. 1, sole ownership over the suit property bearing No. K-33 & 34, West Patel Nagar, New Delhi, by virtue of parties’ settlement over consolidation of the Petitioners’ subsisting 60% undivided share in the property with 20%

undivided share of each of the Respondents, and directed the parties to execute the said relinquishment deeds in the Petitioners’ favour, within two weeks from the date of passing the decree.

Thereafter, the Petitioners, initiated the execution proceedings on 12.09.2022 before the learned ADJ, seeking directions to the Respondents for execution of the Relinquishment Deeds qua their 20% undivided shares each in the suit property, and, specifically, Respondent No. 2 to handover the physical vacant possession of the first floor of the suit premises to the Petitioners.

Subsequently, the Respondent No. 1 filed an objection against execution proceeding under Section 47 read with Order XXI Rule 101, and Section 151 of the of the Code of Civil Procedure, 1908, which was finally put up for order on 12.12.2024, subject to clarifications.

It is the case of the Petitioners that since 12.12.2024 the execution petition is still pending at the stage of pronouncement. Admittedly, subsequent to the 12.12.2024 order, the learned Trial Court directed the parties to submit written synopsis regarding list of dates and events to clarify certain objections vide order dated 10.03.2026.

Thereafter, the learned Trial Court vide order dated 28.03.2026, heard further arguments and once again put up the matter for clarifications or arguments on the next date i.e., 28.04.2026.

It is the Petitioners’ case that despite complying with the directions of the learned Trial Court, in lieu of, passing the final order on the Respondent No. 1’s objection application, the matter has been continually put up for further arguments or clarifications across several dates of hearing.

before the learned Trial Court is 14.07.2026.

In view thereof and having regard to the limited prayer made on behalf of the Petitioners, this Court deems it appropriate to direct the learned Trial Court to decide the matter preferably on 14.07.2026, which is the date already fixed in the matter, if not, it shall make all endeavor to dispose of the same expeditiously within a period of four weeks thereafter, in accordance with law.

The present petition, accordingly, along with pending application(s), if any, stands disposed of.
