Applicant seeks regular bail in case FIR No. 206/2024, registered at Police Station Special Cell, Delhi for commission of offences under Sections 18/29 of the Narcotic Drugs and Psychotropic Substances Act , 1985 .

According to learned counsel for applicant, there is nothing incriminating against the applicant and he has been implicated, merely, on the basis of disclosure statements made by his co-accused. He submits that there is no conscious recovery of any contraband from him or at his instance and, therefore, it is a fit case where applicant should be enlarged on bail.

Learned Addl. P.P. for State has, however, refuted the aforesaid submissions and contends that on the basis of secret information, accused Jagdeep Singh was arrested and 5.200 kgs of opium was recovered from his truck. He named supplier of contraband and apprised that he could lead

police to more recovery and thereafter, one Shamsher Singh was apprehended and when his truck was searched, there was recovery of more than 50 kg of opium. Similarly, there was recovery of huge quantity of opium from truck of one another co-accused Mangal Singh. Thereafter, investigating agency reached Lakhbir Singh @ Lakha and Jarnail Singh and arrested them and when house of accused Lakhbir Singh @ Lakha was searched, there was recovery of 5.385 kgs of opium.

During investigation, police recorded disclosure statement of accused Lakhbir Singh @ Lakha who claimed that contraband in question used to be supplied by the applicant. Notice was issued to applicant to join the investigation but since he did not cooperate, process under Section 82 Cr.P.C. was got issued against him.

Admittedly, thereafter, he surrendered before the Court and was arrested on 17.01.2025. 6. During further investigation and interrogation, mobile phone of applicant was taken into possession. Learned Addl. P.P. for State submits that there is enough of incriminating material in his mobile phone. She submits that such incriminating material includes exchange of account number with his co-accused and photographs of the contraband and its packaging, which clearly indicates his involvement in the drug trafficking in question. She submits that even the call logs collected during the investigation indicate that accused Lakhbir Singh @ Lakha and applicant were in constant touch, just before the recovery in question. She submits that voice sample of the applicant has already been sent to FSL for necessary forensic comparison and report has been received which also indicts the applicant as his voice sample matched with the intercepted voice.

She submits that supplementary charge-sheet has already been filed and copy thereof has already been supplied to applicant, who is the main supplier of contraband.

Charges are yet to be ascertained and it is informed that next date before the learned Trial Court is 18.08.2026.

It will not be appropriate for this Court to make any definite observation with respect to the aforesaid allegations as learned Trial Court is already seized with the matter and charges are yet to be ascertained.

Fact, however, remains that keeping in mind the overall facts and circumstances, this Court does not find any compelling reason to enlarge the applicant on bail, at this stage of the matter. 11. Application is accordingly dismissed.
