By virtue of the present bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( BNSS ) read with Section 438 of the Code of Criminal Procedure, 1973 ( Cr.P.C ), the applicant seeks grant of anticipatory bail in FIR No.225/2024 dated 20.04.2024 registered at PS.: Harsh Vihar, Delhi under Sections 420/34 of the Indian Penal Code, 1860 ( IPC ).

Considering the assertions made, grounds raised and the arguments addressed by the learned counsel for the applicant, though the learned APP for the State has controverted the same, however, he, upon instructions from the Investigating Officer ( IO ), submits that since the applicant has already joined the investigation and he has been

participating therein, including sharing certain details, the applicant shall not be arrested without proceeding in accordance with law. He, however, submits that further interrogation of the applicant is very much required to unearth all the essential details/ facts qua the present FIR. For this, he submits that the applicant shall be called for custodial interrogation, if as and when required.

In response, learned counsel for the applicant submits that the applicant shall continue to join and participate in the investigation, if as and when called.

As such, the present anticipatory bail application is disposed of in the aforesaid terms.
