The accused/applicant seeks regular bail in case FIR No.698/2019 of PS Rajouri Garden for offence under Section 307/392/397/394/120-B/34 IPC and Section 25/27 Arms Act.

Broadly speaking, the allegation against the accused/applicant is that he fired at the victim in the course of robbery, thereby causing him injuries and the accused/applicant was arrested from the spot itself. Subsequently, the accused/applicant was released on bail but thereafter he jumped bail and was ultimately declared Proclaimed Offender. Consequently, supplementary chargesheet for offence under Section 174A IPC also was filed against the accused/applicant.

Despite taking substantial time, learned counsel for accused/applicant is unable to respond to specific queries related to the relevant dates. Even the learned Court of Sessions in order dated 24.12.2025 while rejecting the

bail application of the accused/applicant specifically recorded that learned counsel for the accused/applicant failed to furnish any explanation as regards non appearance of the accused/applicant from 06.07.2023 to 31.08.2024. Further, it is contended by learned APP on instructions of IO/SI Rajendra Dhaka that the accused/applicant is even trying to protract the trial and till date even charge could not be framed, so he has been granted last and final opportunity to address on charge.

Be that as it may, learned APP has produced before me the report obtained from SCRB, according to which as in the month of March 2020, the accused/applicant was involved in 09 more cases of almost similar nature. It is submitted by learned APP that even subsequent to the present FIR, the accused/applicant got involved in 04 more FIRs.

At this stage, learned counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh before the trial court after framing of charges.

As requested, the bail application and the accompanying application are dismissed as withdrawn with liberty as sought.
