By way of the present petition filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks regular bail in case FIR No. 345/2019 dated 03.12.2019 registered under sections 20/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at P.S.: Crime Branch.

The court has heard Mr. Aditya Aggarwal, learned counsel appearing for the petitioner.

It transpires that as per the prosecution case, the petitioner is the owner of the truck which was found carrying 280 kgs of ganja. The petitioner was granted interim bail by the learned trial court vidé order dated 04.11.2020. However, the petitioner absconded, and as a

consequence he was declared proclaimed offender vidé order dated 07.03.2022 and had to be re-arrested on 03.04.2024 i.e., after about 3- 1/2 years. The court is informed that the learned trial court has also framed charges against the petitioner under section 174A of the Indian Penal Code 1860.

Mr. Aggarwal submits, that the order declaring the petitioner, proclaimed offender has been challenged, which proceedings are pending before this court.

Ms. Shubhi Gupta, learned APP for the State also informs the court, that the petitioner and his brother have ‘destroyed’ the truck in which ganja was recovered.

All other things apart, the petitioner’s conduct, namely of absconding for about 3-1/2 years after he was released on interim bail, is reprehensible; after which he had to be rearrested on 03.04.2024. In these circumstances, this court is not inclined to grant the petitioner bail at least at this stage .

The petition is accordingly dismissed and disposed-of.
