% 16.09.2026 1. Applicant seeks interim bail of a period of three months for the reason that his wife had to undergo emergency LSCS on 14.08.2026. She delivered triplets after a complicated surgery and one of their children, unfortunately, died within few hours of his birth while the other two are in NICU, Apollo Cradle and Children’s Hospital situated in Moti Nagar, New Delhi.

Learned counsel for the applicant submits that one such child is stated to be on ventilator and, therefore, at this crucial juncture, the applicant needs interim bail to ensure that there is requisite treatment of his two surviving children, besides providing emotional support to his wife.

When the present application was earlier taken up by this Court on 25.08.2026, as a temporary measure, the applicant was granted custody parole for a period of six hours for 26.08.2026 from 11:00 A.M to 5:00 P.M.

and was directed to be taken to his residence situated at Hari Nagar, New Delhi so that he can meet his wife and was also permitted to be taken to concerned Hospital where his children were admitted.

The abovesaid direction has already been carried out.

The Nominal Roll of the applicant is on record. His custody period in the ongoing murder trial is of more than 11 years. It also indicates various other involvements of the applicant, including one another case of murder, cases of attempted murder and extortion etc. wherein, admittedly, he is on bail.

As per the allegations in the present murder case, two inmates were murdered by him while they were being transported back to the prison from the Court in a Jail van.

The grant of interim bail has been seriously opposed by learned ASC for State. She submits that applicant is a hardcore notorious criminal who falls under the category of ‘ High Risk Prisoner’. She submits that even at the time of his arrest, he was one of the most wanted criminal and had a reward on his head and that he was apprehended with great difficulty. She contends that he not only heads a notorious gang but there are many rival gangs who are after his life and if he is enlarged on interim bail, there would be serious security concerns and there is also a possibility that he may, in the garb of this indulgence, flee away. She submits that that his own life and security would also be at risk if he is released on interim bail and in order to ensure that the public trust and confidence is not undermined, the application may be rejected.

Prosecution does not oppose merely on the basis of the seriousness of allegations in the ongoing murder trial. The antecedents of the applicant and

the fact that he heading a notorious gang demonstrate a real and substantial apprehension that if released on bail, he may indulge in such activities again and may even run away.

Keeping in mind the security concerns expressed by the prosecution and threats perception emanating from his possible release, the prayer regarding release of applicant on interim bail is hereby disallowed.

However, in the interregnum, as a temporary measure, the Court is inclined to grant him another custody parole for a period of six hours for tomorrow i.e. 17.09.2026 from 11:00 A.M to 5:00 P.M, on the same terms and conditions as mentioned in order dated 25.08.2026. Ordered accordingly.

Application stands disposed of in aforesaid terms. 12. A copy of this order be also sent to Superintendent Jail for information and requisite compliance.
