Applicant seeks regular bail in case arising out of FIR No.05/2026 dated 06.01.2026, registered at P.S. Kashmeri Gate for commission of offences under Sections 309(4)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 392/34 IPC).

Learned APP for the State submits that, except for I.O., all the other witnesses, including victim have already been examined.

The next date before the learned Trial Court is stated to be 05.08.2026.

The Court has gone through the testimony of the complainant who has, broadly speaking, supported the case of prosecution and has also duly identified the accused in the witness box.

Learned counsel for the applicant, however, submits that there are lot of contradictions and omissions in his statement.

application it is not appropriate to minutely evaluate the contradiction and omission, if any, in the statement of the complainant. Moreover, in view of the fact that trial is, virtually, over, this Court does not find any real requirement of giving any indulgence in the matter.

After some arguments, learned counsel for the applicant, without prejudice to his rights and contentions, does nor press the present application at this stage. He, however, prays that the learned Trial Court may be requested to expedite the disposal.

The bail application is, accordingly, disposed of as not pressed, albeit , with the request to the learned Trial Court to expedite the recording of the statement of the Investigating Officer and to make best effort to dispose of the matter within a period of three months from the date it takes up the matter.

In case, for any reason whatsoever the case is not disposed of within the abovesaid period, the applicant would be at liberty to revive the present application.
