By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [“BNSS”], the petitioner seeks regular bail in connection with FIR No. 533/2025, dated 05.08.2025, registered at Police Station Bhalswa Dairy, Delhi, under Sections 110/3(5) of the Bharatiya Nyaya Sanhita, 2023.

Mr. Tarang Srivastava, learned Additional Public Prosecutor, at the very outset, submits that the proceedings are at the stage of arguments on charge, which have been heard in part by the Sessions Court.

Mr. Manish S., learned counsel for the petitioner, submits that the material that has been placed before the Sessions Court demonstrates that the petitioner was not present at the site of the incident, and the petitioner was also not named, either in the said FIR or the statement made under Section 180 of BNSS, despite the fact that the petitioner and the complainant

were known to each other. Mr. Manish S. further submits that the petitioner has already advanced his argument on charge, and will also seek discharge before the Sessions Court.

In view of the submissions recorded above, Mr. Manish S. seeks permission to withdraw this bail application at this stage, without prejudice to his rights and remedies before the Sessions Court in accordance with law, including the right to seek bail afresh at the appropriate stage.

The bail application is dismissed as withdrawn, with the aforesaid liberties.

It is made clear that this Court has not made any comment on the merits of the matters and all rights and contentions available to the parties, in accordance with law, are left open.
