By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [“BNSS”], the applicant seeks regular bail in connection with FIR No. 160/2024 dated 08.04.2024, registered at Police Station D.G.B. Road, Central District, Delhi, for offences punishable under Sections 324 and 34 of the Indian Penal Code, 1860 [“IPC”].

The applicant had earlier preferred an application for regular bail, being BAIL APPLN. 4430/2024, which was disposed of by this Court vide order dated 02.04.2025, with the following observations:

“ 3. Learned counsel appearing on behalf of the applicant seeks leave to withdraw the present application with liberty to file a fresh application after the examination of the complainant before the learned Trial Court is complete.

5. Learned Trial Court is requested to ensure that the complainant in the present FIR is examined as expeditiously as possible preferably within a period of 3 months from today. ”

Mr. Mutiur Rehman, learned counsel for the applicant, submits that the complainant has not yet been examined in the present matter. He draws my attention to the order dated 18.04.2026 passed by the learned Trial Court, whereby charges under Sections 307/34 of the IPC have been framed against the applicant. It is apparent from the said order that, following the framing of charges, including under Section 307 IPC, the matter has been adjourned to 16.05.2026, and four witnesses, including the complainant, have been summoned for examination.

In view of the foregoing, Mr. Rehman seeks permission to withdraw the present application at this stage, without prejudice to the applicant’s right to approach the learned Trial Court afresh seeking bail, upon completion of the complainant’s evidence. 5. He further seeks that appropriate directions be issued to ensure the expeditious recording of the complainant’s evidence before the learned Trial Court. It is noted that the complainant has already been summoned for this purpose on 16.05.2026. In these circumstances, the learned Trial Court is requested to take all necessary steps to ensure that the complainant’s evidence is recorded expeditiously. Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor, assures the Court that the prosecution shall not seek any unnecessary adjournment in this regard.

The bail application, alongwith pending applications, is dismissed as withdrawn, in terms of the aforesaid submission.
