Applicant seeks regular bail in case arising out of FIR No. 17/2025 dated 31.10.2025, registered at P.S. Cyber Cell, North East Delhi, for commission of offences under Sections 308/318(4)/319/340 of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 383/420/416/470 IPC). 2. The applicant was arrested in the present matter on 08.01.2025 and is in custody since then.

Learned counsel for the applicant submits that all the other co-accused, who were charge-sheeted alongwith him, are already on bail.

A status report has been submitted by Ms. Dalal, learned APP for the State which is taken on record.

As per such status report, the abovesaid FIR was registered on the basis of complaint of one-Mohd. Salim Sultan who was cheated of Rs. 31,45,000/on the basis of inducement. The complainant had received call from unknown lady on his mobile number who offered him with a business idea and induced

him to invest in their company, claiming that their company was working in stocks. He was, eventually, added to a WhatsApp group and believing them, he invested the abovesaid amount but later on, he came to know that he was victim of the conspiracy of fraud and cheating.

During investigation, it was learnt that the cheated amount was transferred in six different mule bank accounts, one of which was of Ujjivan Small Finance Bank, Kolkata .

As per the bank record, the abovesaid account was in the name of Mahabala Logistics Service Private Limited but there was no clue about the proprietors of the abovesaid company/account-holder and police could not reach them i.e. Anuvesh Singh and Anoop Kumar Shah. However, during investigation, the police reached one Biswajit Mondal (already on bail) and his disclosure led the police team to accused Rajibh Saha and Ashish Agarwal.

The accused Rajibh Saha and Ashish Agarwal revealed the name of Subham Sharma i.e. applicant herein and on the basis of their disclosure statement, the applicant was arrested on 08.01.2026.

Learned APP for the State submits that after his arrest, 25 mobile phones, 144 SIM Cards and multiple debit and credit cards have been recovered from his possession and, therefore, his complicity in the present financial fraud is of a serious magnitude.

I.O. is present in Court with a copy of charge-sheet and Court has gone through disclosure statements of accused Ashish Agarwal and Rajibh Saha. They both are already on regular bail and if the disclosure statement of Rajibh Saha is believed to be true, he claimed that he used to get work done through his worker whose name was Subham.

When asked, I.O. submitted that the recovery of mobile phones, SIM cards, debit and credit cards were not from the residential premises of the applicant, but from the business premises which belong to accused Rajibh Saha.

According to learned counsel for applicant, there are no prior antecedents of the applicant. Nominal Roll was requisitioned and it confirms the same.

Keeping in mind the overall facts of the case, albeit , without making any final observation on the merits of the case, the applicant is admitted to bail, on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate with the following conditions:-

(i) The applicant would provide his Mobile Number to the concerned I.O and would ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court.

(ii) The applicant would not try to come in contact of any of the prosecution witness, directly or indirectly and will not misuse the concession of the bail by indulging in commission of any offence of similar nature .

The present bail application is disposed of in aforesaid terms.

Pending application also stands disposed of.

A copy of this Order be immediately sent to the learned Trial Court and Jail Superintendent for information and necessary compliance.
