Per the injured Rajkumar @ Kale's statement, on 21.06.2021 the applicant and an accomplice allegedly trespassed into his shop on Som Bazar Road and attacked him with an Ustara, two other accomplices standing outside. Applicant seeks bail in FIR No. 455/2021 registered at PS Burari for commission of offence under Section 307/452/34 IPC.

The FIR has been registered on the basis of statement given by the injured himself.

In his statement, injured Rajkumar @ Kale claimed that when he was present at his shop situated at Som Bazar Road on 21.06.2021, the applicant Mohit Walia along with his once accomplice trespassed into his shop and attacked him with an Ustara . His two other accomplices were present outside the shop. He claimed that he could identify the other accomplices also.

The applicant herein was arrested on 24.06.2021 and is in custody since then.

The charge-sheet has been filed and the trial has already begun and the concerned injured i.e. Raj Kumar has already entered into witness box as PW-3.

Learned counsel for applicant submits that one co-accused Prince Panchal is already on bail and since there is no likelihood of trial getting completed in near future, keeping in mind the long incarceration period applicant deserves to be released on bail.

Nominal Roll of the applicant was requisitioned from the Jail Authorities and it indicates his period of incarceration as four years, ten months and seven days as on 30.04.2026. As per the nominal roll, there are two other cases against the applicant in which he is stated to be on bail.

As per the Nominal Roll, applicant is of 26 years of age. 10. Keeping in mind the overall facts and in particular the long incarceration period of applicant, albeit , without observing anything on the merits of the case, the applicant is admitted to bail, on his furnishing personal bond in a sum of Rs. 25,000/- with one local surety of like amount, subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate with the following conditions:-

(i) The applicant would provide his Mobile Number to the concerned I.O and would ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court.

(ii) The applicant would not try to come in contact of public witnesses, directly or indirectly and would not try to threaten or intimidate them in any manner whatsoever .

In case any instance of violation of the aforesaid condition is brought to the knowledge of this Court, same may invite cancellation of the bail.
