Applicant is facing trial for commission of offences under Sections 80/85/3(5) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 498A/304B/34 IPC).

Applicant was arrested on 11.11.2025 and is in judicial custody since then.

Charges have already been ascertained and case is fixed for prosecution evidence. It was to be recorded today but as apprised by learned counsel for complainant (mother of the deceased), since the learned Presiding Officer was on leave, it could not be recorded today.

death is of 22.08.2025. Admittedly, the victim had committed suicide at her parental home by hanging herself.

During investigation, when the statements of relatives of the deceased were recorded by the SDM concerned, it came to fore that there was harassment related to non-fulfilment of dowry demand and it was in the aforesaid backdrop that accused persons have been arrested and charge-sheeted.

Two accused i.e. Veer Bhan (father-in-law) and Aakanksha (sister-in-law) of deceased are already on bail. 7. Applicant herein is also sister-in-law of the deceased. She happens to be wife of elder brother of her husband. She was also, reportedly, residing in the same building, albeit, at a different floor. 8. Learned counsel for applicant submits that case is already at the stage of trial and there are 40 witnesses and there is no likelihood of trial getting concluded in near future. He also submits that there is no specific allegation against the applicant herein and one similarly-situated other daughter-in-law i.e. Ms. Aakanksha has already been released on bail.

Learned counsel for complainant informs that complainant i.e. mother of the deceased has also joined the proceedings through videoconferencing and states that as per instructions, complainant would have no objection if applicant is bailed out, particularly for the reason that her two minor children are in hapless situation, as both their parents are behind the bars.

Learned counsel for the applicant submits that applicant has no other involvement of any nature whatsoever. Nominal Roll of the applicant has been requisitioned which also indicates the same.

Keeping in mind the overall facts and circumstances of the case, the

fact that complainant has given her no objection and the fact that two minor children of the applicant are without love and care of their parents, albeit, without expressing any opinion over the merits of the case, applicant is hereby admitted to bail on her furnishing personal bond in a sum of Rs. 25,000/- with one local surety of like amount, subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class.

The application stands disposed of in aforesaid terms.

A copy of this order be sent to the concerned Court and also to the Jail Superintendent for necessary information and compliance.
