By way of the instant application, the applicant seeks regular bail in connection with the FIR No. 258/2022 for the offences punishable under Sections 302 of the Indian Penal Code, 1860 and Section 27 of the Arms Act, 1959.

Mr. Vimal Tyagi, learned advocate appearing on behalf of applicant submits that the present applicant is seeking bail on the ground of parity as co-accused Vishan @ Vishu and Prashant Chaudhary are already enlarged on bail by this Court and the role assigned to the present applicant as well as the co-accused, Prashant Chaudhary is almost similar.

Ms. Shubhi Gupta, learned APP, however, points out that in the case of the present applicant, there is recovery of country made pistol ( desi katta )

as well the motor cycle which was used in connection of the said offence. She, thus, contends that there is additional material qua the present applicant.

Be that as it may, all the aforesaid aspects would, in any event, fall for consideration and examination by the concerned Court in accordance with law during the course of trial. 5. The Court, however, finds that, by a detailed order passed in the case of Prashant v. State Govt. of NCT of Delhi¹ , this Court has already considered the facts and circumstances of the case and observed that the present applicant, along with the co-accused, Prashant Chaudhary, had assisted the main accused in the commission of the offence in question. 6. Bearing in mind the findings and reasons already recorded in Prashant v. State (Supra), this Court is of the considered view that the present applicant is also entitled to the grant of regular bail. It is pertinent to note that the applicant has been in custody since 2022 and has already undergone incarceration for about four and a half years. Of the 40 prosecution witnesses cited, only nine have been examined thus far. The delay in the conduct of the trial is not attributable to the present applicant, and the trial, in any event, is likely to take considerable time to conclude. 7. Accordingly, the applicant is directed to be released on regular bail, subject to the conditions to be imposed by the concerned trial Court.
