This matter is taken up today as 03.03.2026 was declared holiday vide Notification No. 64/G-4/Gen1.-I/DHC dated 27.02.2026.

The present petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (for short „the Act‟) for appointment of an arbitrator. 3. The brief facts are that the petitioner was the successful bidder in the tender invited by the respondent for “Supply, Installation, Testing and Commissioning (SITC) of Biometric Access Control System (ACS) at 43 airports across the country”. By a Letter of Acceptance dated 23.12.2016, the bid of the petitioner was accepted and thereafter, an Agreement dated 16.01.2017 was executed between the parties. Disputes arose between the parties to the lis . The petitioner by letter dated 21.11.2025 initiated arbitration proceedings invoking Clause 4 of the Contract read with Clause

Learned counsel for the respondent on instructions has no objection for referring the matter to arbitration.

Accordingly, the petition is allowed by appointing Justice Ms. Jaishree Thakur (Retd.) (Mobile No.08558809950) as the sole arbitrator for adjudication of the disputes which have arisen between the parties.

The fees of the learned Arbitrator will be governed by Schedule IV of the Act. Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act.

It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties, it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law.

A copy of this order be forwarded to the learned Arbitrator for information.
