Vriddhi International Pvt. Ltd. Vs Soothe Healthcare Pvt. Ltd.

This is a petition under Section 11(6) of the Arbitration & Conciliation Act, 1996, for appointment of an Arbitrator to adjudicate the disputes which have arisen between the parties.

It is stated that a distribution agreement dated 17.12.2021 was executed between the parties, and the Petitioner was appointed as the sole distributor for the goods manufactured by the Respondent in the territory of Nepal.

It is stated that an order for the sum of Rs.22,50,547/- was placed by the Petitioner with the Respondent. However, the goods supplied by the Respondent were defective, and the Petitioner raised the same with the Respondent.

It is stated that since the Respondent did not resolve the issues faced by the Petitioner and has also failed to fulfil its obligations under the agreement, the Petitioner issued notice dated 14.11.2025 invoking the arbitration clause. It is stated that as both parties failed to appoint an arbitrator, the Petitioner has approached this Court for the appointment of an Arbitrator. Clause 13 of the Agreement entails an arbitration clause and provides that the disputes between the parties shall be referred to the Delhi International Arbitration Centre (DIAC).

Notice was issued in the present Petition on 17.02.2026. The Respondent stands served. Learned Counsel for the Respondent states that the Respondent does not have any objection to the appointment of an arbitrator.

Accordingly, Mr. Aman Mehta, Advocate (Mob No: 8155069478) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.

The arbitration would take place under the aegis of DIAC and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act within a week of entering on reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to state, nothing in this order shall be construed as an expression of this Court on the merits of the contentions of the parties.
