This order is being passed in view of a similar order dated 26.09.2022 passed in W.P.(C) 13638/2022, covering the present issue. Based upon the said order and using the same reasons and expressions, this order is being passed.

The petitioner-Institution was granted recognition on 16.08.2005 by respondent No. 2-Northern Regional Committee (NRC), NCTE for running a B.Ed. course with an intake of 100 seats. The NCTE (Recognition Norms and Procedure) Regulations, 2014 [“2014 Regulations”] were notified on 01.12.2014 and vide letter dated 24.12.2014 issued by NCTE to all regional committees, it was communicated that revised recognition order would be issued, provided existing institutions furnish the required affidavit in the prescribed format as given in the ‘Explanatory Note’. Thereafter, the petitioner institute submitted required affidavit for issuance of revised recognition order on16.05.2015. However, despite lapse of time, revised recognition order has not been issued.

Learned counsel for petitioner-Institution states that recognition of petitioner-Institution continues, but the affiliating university is not permitting admissions. He submitted that the issue raised in the present petition is covered by various decisions of this Court including the decision in Shri Shakuntal Secondary Teachers Training College & Anr. v NCTE & Anr. wherein this Court directed the respondents to decide the petitioners' request for a revised recognition order within a

stipulated timeframe. He further submits that until the said request is decided, the petitioner-Institution must continue to be treated as a recognised institution for all purposes.

Learned counsel for respondents does not dispute the fact that the issue raised in present petition is covered by the aforesaid decision.

This Court notes that the recognition given to Petitioner-Institution for 100 seats continues to be in operation under NCTE Act, 1993 and has admittedly not been withdrawn. Accordingly, Petitioner-Institution shall be treated as a recognized institution for all purposes till any contrary orders are passed by the respondents in accordance with law. It is directed that the respondents will take all consequential steps forthwith including correcting the status of petitioner-Institution on their website, informing the Department of Higher Education, Government of Uttar Pradesh and the affiliating University/ concerned authority to enable the petitioner-Institution to participate in the counselling and admission process for the B.Ed. course.

In the meantime, let the respondents decide on the request of the petitioner-Institution for issuance of revised recognition order for B.Ed. course with 100 seats expeditiously, preferably within 4 weeks from today.

In view of the above directions, the petition along with the pending application, stands disposed of.
