Notice in the present petition was issued on 14^th July, 2026.

Status report has been filed by the respondent no.1/MCD, wherein it is stated that upon inspection, it came to notice that commercial activities are being carried at the Ground Floor and First Floor of the subject property in the shape of running of ‘wholesale and distribution’ under the name and style of ‘Blinkit Dark Store’.

Section 345-A of the DMC Act (Annexure A to the status report). A reply was received to the said show cause notice. Subsequently, a sealing order has been passed on 24^th August, 2026 (Annexure B to the status report).

A copy of the sealing order has been supplied to Mr. B.B. Gupta, senior counsel appearing on behalf of the private respondents no.4 and 5. 6. Mr. Gupta submits that he will be taking appropriate remedies in law in respect of the said sealing order.

Insofar as the grievance of the petitioner as set out in prayer (c) above, a direction is issued to respondent no.1/MCD and/or respondent no.2/DDA, as the case may be, to re-erect the boundary wall which has been demolished, as reflected in photographs at Page 31 of the writ petition.

In view of the above, the present writ petition stands disposed of.

Liberty is given to the private respondents to challenge the sealing order in accordance with law within two (2) weeks from today.

For a period of two (2) weeks, no coercive steps shall be taken against the subject property.

¶29

It is made clear that no observations with regard to merits of the case have been made and this order has been passed only so as to enable the private respondents to invoke their statutory remedy of appeal.
