This writ petition seeks the following relief:

“1. Issue a Writ of Mandamus or any other appropriate writ, order, or direction commanding the Respondents to forthwith release the remuneration of all Part-Time Vocational Teachers for the period 11.05.2024 to 30.06.2024 without any further delay.

2. Issue a Writ of Mandamus directing the Respondents to issue uniform directions to all Heads of Schools to disburse the withheld remuneration in strict compliance with the budget sanction order dated 22.03.2024.

3. Award costs of the petition to the Petitioners.

¶15

4. Pass such other and further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case.”

On the other hand, counsel for the Respondents raises a preliminary objection as to the maintainability of the present petition, submitting that the issues raised herein are amenable to the jurisdiction of the Central Administrative Tribunal under the Administrative Tribunals Act, 1985. It is further submitted that, in view of the law laid down by the Supreme Court in L. Chandra Kumar v. Union of India & Ors. ,¹ the present writ petition is not maintainable.

In view of the aforesaid objection, Mr. Yashasvi Virendra, counsel for the Petitioners, seeks leave to withdraw the present petition with liberty to approach the Central Administrative Tribunal, in accordance with law.

Leave and liberty as prayed for, are granted.

The Court has not commented on the merits of the case. All rights and contentions of the parties are left open.
