Heard learned counsel for the respective parties.

The contentions of the learned counsel for the petitioners are that they are entitled for ACP and MACP benefits, which the respondents have unreasonably and illegally denied. According to them, the issue is squarely covered by the judgment of the learned Division Bench of this Court in the matter of Om Prakash Vs. Union of India reported in W.P. (C) No. 388/2015 dated 29.01.2016, which was subsequently confirmed by the Apex Court in S.L.P (C) No. 24453-24458/2016 titled as UOI vs. Om Prakash vide order dated 12.12.2024. It is his contention that based on the aforesaid, a representation was preferred by the petitioners on 11^th /12^th March, 2026 and till this date, neither the representation is decided nor the benefits are passed on.

As against above, the learned counsel for the respondents states that having regard to the last order of this Court, so also, the orders passed in the matters of Om Prakash Vs. Union of India (supra) and Suresh Kumar & Anr. Vs. Union of India & Ors. [W.P.(C) No.11267 of 2021 dated 6^th March, 2025], the representation of the petitioners can be decided in a reasonable period.

In that view of the matter, we deem it appropriate to dispose of the present petition with the following orders:

a. The representation of the petitioners dated 11^th /12^th March, 2026 (Annexure P4) is directed to be decided by the competent authority in any case within a period of 12 weeks from today.

b. While deciding the representation, the respondents must have regard to the pleadings of the present petition also.

c. The judgments referred above, namely Suresh Kumar (Supra) and Om Prakash (supra), shall be taken into account for deciding the representation.

d. In case, if the representation of the petitioners is allowed and they are held entitled for ACP/MACP benefits, let the consequential orders to that effect be issued within a period of 4 weeks from the date of passing of the order, and to be communicated to the petitioner.

e. Furthermore, it is directed that the benefits, if any, including that of arrears be released to the petitioners expeditiously and in any case within a period of 3 months thereafter, which shall carry interest @ 8% per annum.

f. We make it clear that, in case, if the order passed is averse to the interest of the petitioners, it shall be open for the petitioners to question the legality of the same before the competent authority, as we have not gone into or appreciated the merits of the case.
