Shri Dipanjan Das Vs Government of NCT of Delhi and Others

The Petitioner, who is presently working as General Manager (Technical) in Respondent No. 4, Delhi Transco Limited (DTL), assails Office Order dated 09^th June, 2026 and Office Order dated 02^nd September, 2024, whereby the charge of the post of Director (Operations), DTL, has been assigned on a look-after/additional charge basis. The Petitioner also seeks a direction to the Respondents to undertake and complete the regular selection process for appointment to the post of Director (Operations), DTL, in accordance with the applicable Recruitment Rules.

The Petitioner submits that he falls within the zone of consideration for appointment to the post of Director (Operations), which fell vacant upon the superannuation of the incumbent, Shri Mukesh Kumar Sharma, on 31^st

August, 2024. It is submitted that the said post is presently being held on a look-after/additional charge basis by an officer who is junior to the Petitioner.

The grievance of the Petitioner is that despite the vacancy having arisen and the Petitioner being within the zone of consideration, the Respondents have not initiated the regular selection process. It is submitted that the Petitioner has made several representations requesting that his candidature be considered in accordance with the applicable Recruitment Rules.

It is further submitted that the Petitioner is due to retire in November, 2026 and, unless the selection process is undertaken expeditiously, he would be deprived of consideration for the post despite being eligible when the vacancy arose.

Mrs. Avnish Ahlawat, SC for GNCTD, submits that the representations placed on record do not disclose the complete factual background and, therefore, she is presently not in a position to verify the Petitioner’s claim that he is senior to the officer presently holding the additional charge.

Having regard to the fact that the Petitioner’s representations are pending consideration and his date of superannuation is approaching, it would be appropriate to dispose of the petition by directing the Respondents to treat the present writ petition as a representation, in addition to the representations already submitted by the Petitioner, and to consider the Petitioner’s claim for appointment to the post of Director (Operations) in accordance with law.

eligibility. The competent authority shall consider the Petitioner’s claim and pass a reasoned and speaking order within a period of six weeks from today.

If the Petitioner remains aggrieved by the outcome of the decision, he shall be at liberty to take recourse to appropriate remedies.
