The present writ petition has been filed seeking a direction to respondent-MCD to enforce the demolition order dated 9^th January, 2026 qua unauthorized construction carried out by respondent no.4 at property bearing no. 4779-4782, Gali No.45-46, Regharpura, Karol Bagh, New Delhi110005 (‘subject property’).

Counsel appearing on behalf of the petitioner submits that the petitioner resides in the basement and ground floor of the said property, whereas unauthorized construction has been carried out at the fourth and the fifth floor of the subject property by respondent no.4.

Counsel for the respondent-MCD submits that an appeal has been filed by the respondents no.4 and 5 before the Appellate Tribunal MCD
