This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :-

“i. issue a writ of mandamus or any other suitable writ, order or direction directing the Respondents to issue revised recognition order for 50 Seats of M.Ed. Course to the Petitioner institution under NCTE Regulations, 2014; and/or ii. issue direction/order holding that the recognition granted to the petitioner for M.Ed. Course continues to be in operation under the NCTE Act and the petitioner be treated as a recognized institution for all purposes and the respondents be directed to take all consequential steps including correcting the status of petitioner institution as a recognized institution on their website and to inform the affiliating body and the Department of Higher Education,

Government of Gujarat enabling the petitioner to conduct the M.Ed. Comse as well as participate in counselling & admit students; and/or…”

This order is being passed in view of a similar order dated 26.09.2022 passed in W.P.(C) 13638/2022, covering the present issue. Based upon the said order and using the same reasons and expressions, this order is being passed.

Petitioner-Institution was granted recognition on 14.03.2008 by Respondent No. 2-Western regional Committee (WRC), NCTE for running a M.Ed. course with an intake of 25 students. The NCTE (Recognition Norms and Procedure) Regulations, 2014 [“2014 Regulations”] were notified on 1st December, 2014 and vide letter dated 24th December, 2014, issued by NCTE to all regional committees, it was communicated that revised recognition order would be issued, provided existing institutions furnish the required affidavit in the prescribed format as given in the ‘Explanatory Note’. Thereafter, the petitioner submitted required affidavit for issuance of revised recognition order in January, 2015 and also on 04.04.2026. However, despite lapse of time, revised recognition order has not been issued.

Counsel for Petitioner-Institution states that recognition of Petitioner-Institution continues, but affiliating university is not permitting admissions. The issue raised in the present petition is covered by various decisions of this Court including the decision in Shri Shakuntal Secondary Teachers Training College & Anr. v NCTE & Anr. 1 wherein this Court directed the respondents to decide the petitioners' request for a revised recognition order within a stipulated

timeframe. He further submits that until the said request is decided, Petitioner-Institution must continue to be treated a recognised institution for all purposes.

Counsel for Respondents, does not dispute the fact that the issue raised in present petition is covered by the aforesaid decision.

This Court notes that recognition given to Petitioner-Institution for 50 seats continues to be in operation under NCTE Act, 1993 and has admittedly not been withdrawn. Accordingly, Petitioner-Institution shall be treated as a recognized institution for all purposes till any contrary orders are passed by Respondents, in accordance with law. It is directed that Respondents will take all consequential steps forthwith including correcting status of Petitioner-Institution on their website, informing the Department of Higher Education, Government of Gujarat and affiliating University/ concerned authority to enable Petitioner-Institution to participate in counselling and admission process for the M.Ed. course.

In the meantime, let Respondents decide on the request of Petitioner-Institution for issuance of revised recognition order for M.Ed. course with 50 seats expeditiously, preferably within 4 weeks from today.

In view of the above directions, the petition stands disposed of along with pending application(s).
