The Petitioners participated in the recruitment process initiated by Respondent No. 1 pursuant to Advertisement No. 01/2022 dated 01^st February, 2022 for the post of Deputy Director (Administration). The selection process comprised a screening/written test followed by an interview. The Petitioners qualified the screening/written test and were thereafter called for the interview held on 18^th March, 2024, in which they participated. Their grievance is that despite repeated follow-ups, the outcome of the selection process was not communicated to them. In these circumstances, they have approached this Court seeking, inter alia , a direction to Respondent No. 1 to declare the final result/merit list for the

post in question. Upon notice being issued, the Respondents have filed a short affidavit, enclosing therewith a notification dated 30^th July, 2026, which reads as follows:

A proposal on the “Recruitment of teaching faculty & Dy. Director (admin) vide Advt. No. 01/2022” was placed before the Governing Council in its 18th meeting held on 09.07.2024 vide agenda item No.02 which may be read as under;

I. Governing Council is being apprised about the process initiated for recruitment against above posts with the approval of Hon’ble MoH GNCTD. Advertisement for recruitment of Professor and Associate Professors was cancelled as advertised posts were not as per Roster. Hence, fee was also refunded.

II. The recruitment process to the post of Dy. Director (Adm.) was also put on hold on the direction of higher authority. Later on, the proposal was resubmitted with request for resumption of recruitment process vide Advt. 01/2022. Hon’ble MoH being Chairman Governing Council considered the proposal in concerned recruitment file CDH00067688. After approval of Hon’ble MoH, the written/screening test and interview for post of DD (Admin) was conducted on 17.03.2024 &18.03.2024 respectively. Accordingly, three candidates were found eligible for interview and the expert panel has given the remarks as NFS (None Found Suitable) & the same has been forwarded through concerned file CDH00067688 for the approval of Honorable chairman GC.

Hence, GC may ratify the steps taken so far the resuming the recruitment process further and approval of result/ decision for post of DD (Admin.). This is humbly submitted that as per RR of Deputy Director (Admin), now the post must be filled by deputation.

the post of Deputy Director (Administration), which had initially been put on hold at the direction of the higher authority, was subsequently resumed. The screening/written test and interview were thereafter conducted on 17^th March, 2024 and 18^th March, 2024, respectively. Three candidates were found eligible for the interview; however, the expert panel recorded its remarks as “NFS (None Found Suitable)”. The matter was thereafter placed before the Governing Council, which, in its meeting held on 09^th July, 2024, ratified the steps taken in the recruitment process, approved the result/decision of the interview and directed that the post be filled by deputation in accordance with the applicable Recruitment Rules. The Respondents further state in their short affidavit that the recruitment file was thereafter forwarded to the Department of Health and Family Welfare, GNCTD, for final approval of the Minister, who is the Chairperson of the Governing Council, and that the same is presently pending before him.

Be that as it may, the recruitment process was initiated pursuant to Advertisement No. 01/2022 and the screening/written test and interview were concluded in March, 2024. The result of the recruitment process ought therefore to be formally declared. Accordingly, while reserving all rights and contentions of the Petitioners in the event they are aggrieved by the result so declared, the present petition is disposed of with a direction to Respondent No. 1 to declare the result within a period of four weeks from today, after obtaining such approval as may be required from the Chairperson of the Governing Council, in accordance with law.
