Writ Petition under Article 226 of Constitution of India has been filed on behalf of the Petitioner for issuing appropriate directions for quashing the Cancellation Communication Letter dated 18.04.2026 whereby the Petitioners Offer of Appointment/candidature for the post of Nursing Officer, Post Code 02/24 was cancelled on the ground that he failed to submit OBC-NCL Certificate for 2023-24 and to direct the Respondents to treat the Petitioner as eligible under OBC-NCL category for recruitment and to issue of Appointment Letter and complete appointment formalities forthwith.

Learned Counsel for the Petitioner states that vide e-mail dated 07.02.2026, the Petitioner was informed after complete document verification that no discrepancy was found and medical letter was issued to appear before the medical authorities for medical fitness. However,

subsequently on 18.04.2024, Petitioner’s appointment was cancelled on the ground of failure to submit OBC-NCL Certificate for the financial year 2023-24.

It is submitted that the clarification had been sought from the Government, which was issued by Department of Health and Family Welfare, Govt. of NCT of Delhi vide Letter dated 14.01.2026 that the Hon’ble Court has held that the OBC-NCL Certificate serves as a proof of the existing fact not an academic qualification and thus, should be accepted even if it is issued beyond the prescribed date. The Administrative Department is advised to consider the above legal position for further necessary action in the matter.

It is submitted that despite this clarification and Appointment Letter being issued in February, 2026, it has been arbitrarily revoked vide Letter dated 18.04.2026. Therefore, the Petitioner has claimed for the appropriate directions.

On advance Notice, learned Counsel for the Respondents has appeared and has submitted that this pertains to the service matter and the Writ Petition is not maintainable. The Petitioner should have approached CAT for the appropriate remedy.

In view of the submissions made, as agreed, the Writ Petition is disposed of along with pending Applications, with the directions to the Respondent to keep one vacancy vacant for the next 10 days. In the interim, the Petitioner is at liberty to approach CAT in accordance with law.
