The writ petitions, are filed by the Petitioner, challenging the penalty orders dated 03.09.2024 and 01.10.2024, passed by the Disciplinary Authority.

It stands recorded in the above orders that “Force No.155041178 SI/GD Chand Singh-70 Battalion is also informed that if he wishes to prefer an appeal against this order passed by the Disciplinary Authority, he may prefer it as per the provisions contained in Rule 28 of the CRPF Rules, 1955, within 30 days from the date of issue of this order to the Appellate Authority, i.e. Inspector General of Police, Western Sector, CRPF, Navi Mumbai.”

It emerges that under Rule 28 of Central Reserve Police Force Rules, 1955, the correctness of the impugned penalty orders can be challenged by filing the statutory appeal before the Competent Authority and the Appeal is to be filed within a period of 30 days from the date of original order. On being pointedly asked, it has been informed that the Petitioner has never availed the alternate efficacious remedy i.e. a statutory Appeal in the aforesaid time and has directly filed the writ petitions before this Court.

After arguing for some time, in view of the above, the learned counsel representing the Petitioner seeks permission to withdraw the present writ petitions, in order to avail statutory alternative remedy by filing the Appeal.

Ordered accordingly. The petitions are dismissed as withdrawn,
