The Petitioner was appointed as TGT (Social Science) with Respondent No. 3 school. On 21^st October, 2024, she tendered her resignation, a copy whereof has been placed on record as Annexure P-4. It is her case that despite submission of the resignation, no formal order relieving her from service was issued by the school.

It is further stated that on 13^th March, 2025, the Petitioner received a communication stating that an excess payment of INR 27,495/- detected during an audit of the school’s accounts, was liable to be recovered. Thereafter, on 10^th November, 2025, the Petitioner received another communication indicating that a further sum of INR 2,491/- was recoverable from her. The Petitioner submits that both the aforesaid amounts have since been refunded and has furnished proof thereof. Thereafter, no further communication has been received from the Respondents.

It is her contention that under Rule 114A of the Delhi School Education Rules, 1973, a decision on the resignation is required to be communicated within 30 days, with the approval of the Director of Education.

At this stage, however, this Court is not inclined to adjudicate the matter on merits by presuming the Petitioner’s assertions to be correct. Accordingly, while keeping the rights and contentions of the Respondents open, the present petition is disposed of with a direction to the Respondent school to pass a reasoned order on the Petitioner’s resignation dated 21^st October, 2024, in accordance with law. In the event the Petitioner is to be relieved from service, the requisite relieving letter and experience certificate shall be issued to her. In the event any further amount is found due from the Petitioner, the same shall be duly intimated to her.

Conversely, if the school is of the view that the Petitioner cannot be relieved from service, a speaking order disclosing the reasons for such decision shall be passed.

The above directions be complied within a period of four weeks from today.

The Petitioner’s prayer for compensation on account of alleged inaction on the part of the Respondent school is not entertained, in view of the apparent delay on the part of the Petitioner in approaching this Court.

The present petition is disposed of.
