This is a writ petition filed under Article 226 of the Constitution of India seeking the following reliefs:

“a) Issue a writ of mandamus, or a writ in the nature of mandamus, or any other appropriate writ, order or direction quashing the decision of Respondent Nos.1-2 & 4 in shifting the Mirambika Free Progress School from where it has existed for 25 years;

b) Issue a writ of mandamus, or a writ in the nature of mandamus, or any other appropriate writ, order or direction

restraining the Respondents from shifting the Mirambika Free Progress School from where it has DoE sanction to function;

c) Issue a writ of mandamus, or a writ in the nature of mandamus, or any other appropriate writ, order or direction restraining the Respondents from proceeding with establishing a college at the leased premises; and”

The present petition was filed to challenge the shifting of Mirambika Free Progress School from landmark building on grounds adjacent to Aurobindo Ashram and Mothers International School where it has existed for 25 years, by the parents of the erstwhile students who were studying in the school and in that view had a vested right and interest in the subject matter of where the school was situated and/or its shifting.

The petition was filed in the year 2015 and admittedly, none of the wards of the petitioners are now studying in the said School.

For the said reasons, the petition has become infructuous and is disposed of.

¶20

In case the petitioners have any cause of action, they shall be entitled to avail of it in accordance with law.
