The Court is of the opinion that the impugned orders dated 29.08.2019 and 15.10.2019 were passed in violation of the principles of natural justice. Consistent with the line of precedents emerging from the orders rendered in the aforenoted cases, the instant petition stands disposed of, with the following terms:

a. The impugned order sands set-aside.

b. Let the respondent no.2 to issue a show cause notice (‘ SCN’ ) within 45 days from the date of receipt of a copy of the order passed today.

c. Once the petitioner receives the said the notice, let the reply be filed within 30 days thereafter; and

¶20

d. The concerned authority, thereafter, shall be at liberty to pass an appropriate speaking order.

If the petitioner thereafter has any grievance, it shall be at liberty to take appropriate recourse in accordance with law.
