Delhi High Court (V. Kameswar Rao & Manmeet Pritam Singh Arora, JJ.) disposed of W.P.(C) 363/2026 & CM APPL. 1774/2026 (order dated 12.01.2026) filed by 76 petitioners led by Insp. Exe Manoj Kumar Yadav, who sought a mandamus directing the DG CISF to re-fix their pay with effect from 16.07.2007 and to pay arrears of refixed pay with interest at 9% per annum, invoking Harjinder Singh & Ors. v. Union of India, W.P.(C) 9256/2020 (decided 06.01.2021), which had granted pay fixation upon promotion to the rank of Sub-inspector through LDCE with reference to Brahma Prakash & Ors. v. Union of India, W.P. (C) 3636/2016. Counsel for the respondents, without disputing that the issue is covered by Harjinder Singh & Ors. This petition has been filed with the following prayers:-

“i. Issue a Issue a writ of Mandamus or any other appropriate writ, order, or direction, directing the DG CISF to re-fix the Petitioners (76) pay with effect from 16.07.2007, in view of the judgment of this Hon'ble Court in Harjinder Singh & Ors. v. Union of India and to extend this judgement on the Petitioners (76) in time bound manner.

ii. Issue a writ of Mandamus or any other appropriate writ, order, or direction directing the DG CISF to pay the Petitioner (76) arrears of Refixed pay w.e.f. 16.07.2007, along with interest at 9% per annum in view of judgment of Delhi High Court H arjinder Singh & Ors. v. Union of India.

In effect, the petitioners are praying for the benefit as has been granted by this Court in the case of Harjinder Singh & Ors. v. Union of India, W.P.(C) 9256/2020 decided on 06.01.2021 wherein, this Court by referring to the judgment of this Court in the case of Brahma Prakash & Ors. v. Union of India, W.P. (C) 3636/2016, has granted pay fixation upon promotion to the rank of Sub-inspector through LDCE.

Learned counsel for the respondents who without disputing that the issue is covered by the judgment in the case of Harjinder Singh & Ors. (Supra) states that the respondents shall consider the writ petition as a representation on behalf of the petitioners and decide the same within 12 weeks. If that be so, we direct, this writ petition shall be considered as representation, and the decision as taken shall be communicated to the petitioners within 12 weeks as an outer limit.

Suffice to state, the respondents had called for a revised option from one of the petitioner no.58 i.e., Nripati Biswas.
