This petition has been filed with the following prayers:-

“A. Issue a Writ of Mandamus or any other Writ, direction or order directing Respondents to grant the grade pay of Rs.4200/- to the Petitioners with effect from the date of their respective joining along with consequential pay fixation and release of arrears; and

B. Pass such other order(s) as this Hon'ble Court may deem fit in the facts and circumstances of the present case.”

In effect, the petitioners were working as SI Radiographer in the Sashastra Seema Bal (SSB). They are seeking the benefit of the judgment rendered by the Central Administrative Tribunal in respect of Radiographers holding civil posts (non-uniform) for the grant of grade pay of Rs. 4200/-.

4200/- is with effect from 2009. The only reason given by Mr Varghese, learned counsel for the petitioners, justifying the filing of the writ petition in 2026 is that the Radiographers (non-uniform) had approached the Central Administrative Tribunal in 2015 and the judgment was rendered by the Tribunal in April, 2022.

It is a conceded fact that the petitioners have submitted representations in the year 2025 seeking the benefit thereof. The same have not been considered.

Appropriate shall be for the respondents, to consider this writ petition as a representation on behalf of the petitioners and decide the same within a period of eight (8) weeks.

While deciding so, if the respondents intend to grant the benefit to the petitioners of the judgment of the Central Administrative Tribunal, they are within the right to limit the grant of the benefits pursuant thereof, as deemed appropriate.

The petition stands disposed of along with pending applications.
