Delhi High Court (Jasmeet Singh, J.) disposed of a writ petition under Article 226 filed by Prem Lata seeking directions to respondents Nos. 1 to 4 to stop further unauthorized construction by respondent No. 5 at A-172, IIIrd Floor, DDA Flat, New Ranjit Nagar, New Delhi, and to seal and demolish it in accordance with the D.M.C. Act. The petitioner's earlier writ (W.P.(C) No. 13002/2024, decided 17.09.2024) had been disposed of with liberty to institute a civil suit or approach the STF; pursuant thereto the petitioner approached the STF, which filed a status report recording that the property had been booked u/s 344(1) and 343 of the DMC Act as unauthorized construction (one room covering open space between A-172 and A-188) vide file no. 30/C-87/B/UC/KBZ/25 dated 18.02.2025. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :-

“(i) Direct the respondent Nos. 1 to 4 Lo take immediate action to stop further unauthorized construction or any other building activity by the respondent No. 5 on the property, Address- A- 172, III^rd Floor, DDA Flat, New Ranjit Nagar, New Delhi -110008.

(ii) Direct the respondent Nos. 1 to 4 to take action in accordance with the D.M.C. Act to seal and further

The petitioner had earlier preferred another writ petition bearing W.P.(C) No. 13002/2024 titled Prem Lata v. Municipal Corporation Of Delhi Central Zone & Ors. , wherein this Court in the paragraph Nos. 6 and 7 of the Order dated 17.09.2024, has issued the following directions:

“6. In view of the aforesaid, instead of keeping this petition pending on the Board of this Court, the petitioner is granted liberty to institute a civil suit against the concerned respondent or to approach the STF by way of proper representation along with the copy of this order. If the petitioner does so, let the grievance of the petitioner be dealt with by the STF, in accordance with law, as expeditiously as possible.

7. In view of the aforesaid, reserving the aforesaid liberty in favour of the petitioner, the instant writ petition stands disposed of.”

Pursuant to the said liberty granted vide the aforesaid Order, the petitioner has already approached the STF by way of proper representation.

In case the petitioner is aggrieved by further action/inaction, the petitioner shall be at liberty to approach the Court in accordance with the law.
