The Petitioner was employed as a Laboratory Assistant with Respondent No. 3, Jain Senior Secondary School, an aided minority school, and superannuated from service on 30^th June, 2025. He alleges that his retiral benefits, including pension, gratuity, commutation of pension, provident fund and other admissible dues, have not been fully processed and released.

No counter affidavit has been filed by any of the Respondents. However, counsel appearing for the respective parties have been heard at length. Since the controversy lies within a narrow compass and the directions proposed to be issued are intended to secure verification and

expeditious settlement of the Petitioner’s retiral dues, the Court proceeds to decide the petition on the basis of the pleadings and documents on record, as well as the oral submissions advanced by counsel.

Counsel for the Petitioner submits that the Petitioner duly completed all formalities required upon retirement and handed over charge in accordance with the applicable procedure. It is contended that, notwithstanding the lapse of a considerable period thereafter, the Petitioner has neither been furnished with an account of the retiral benefits payable to him nor informed of the reasons for withholding any part of his retiral dues. 4. Counsel appearing for the School submits that the Petitioner had availed loans from certain banks and cooperative societies and had also stood as a surety in respect of other borrowings. It is submitted that, pursuant to recovery notices issued by the competent authorities, deductions were made from the salary of the Petitioner and the amounts were remitted to the concerned banks and cooperative societies. According to the School, these transactions require reconciliation before the net amount payable to the Petitioner can be determined.

Ms. Latika Choudhury, counsel appearing for the Government of NCT of Delhi, submits that the Directorate of Education had called upon the School to furnish complete particulars of the Petitioner’s retiral dues. The School has since furnished certain details regarding the deductions made and the payments stated to have been remitted to banks, cooperative societies and other creditors. She submits that these particulars are presently under verification by the Directorate and that the exercise is likely to be concluded shortly.

justify such deductions as are authorised by law. It cannot, however, furnish a basis for withholding the entirety of the Petitioner’s retiral benefits for an indefinite period. Each deduction must be identified, supported by the relevant order or statutory provision, and duly accounted for. Equally, amounts which are undisputed and are not subject to any lawful withholding/deductions must be released without awaiting resolution of every disputed entry.

The record also contains a communication dated 24^th September, 2025 issued by the office of the Deputy Director of Education, Central/New Delhi District, approving final withdrawal of INR 1,06,270 from the Petitioner’s provident fund account, together with up-to-date interest. The Respondents are required to clarify whether the said amount has been released and, if not, the reason for its withholding.

In these circumstances, the following directions are issued:

8.1 Respondent No. 3 shall, within ten days, submit to the Deputy Director of Education, Central/New Delhi District, the complete retiral dossier of the Petitioner, together with an itemised statement setting out:

a. the amount payable under each head of retiral benefit;

¶28

b. every deduction made from the salary or retiral dues of the Petitioner;

¶29

c. the authority, attachment order or other legal basis for each deduction;

¶30

d. the date and mode of remittance of every amount deducted; and

¶31

e. documentary proof of payment to the concerned bank, cooperative society or recovery authority.

A copy of the statement and the supporting documents shall simultaneously be supplied to the Petitioner.

8.2 The Petitioner may submit his objections to the said statement within

one week of its receipt.

8.3. The Deputy Director of Education, Central/New Delhi District, assisted by the concerned Senior Accounts Officer, shall thereafter undertake a reconciliation of the Petitioner’s account. The School and the Petitioner shall be afforded an opportunity to place their respective records before the authority. The exercise shall be completed within four weeks.

8.4 In undertaking the exercise, the Deputy Director shall permit adjustment only of such amounts as are supported by a subsisting recovery or attachment order and are otherwise legally recoverable from the particular head of retiral benefit. The underlying liability determined by any competent recovery authority shall not be reopened in these proceedings.

8.5 The approval dated 24^th September, 2025 concerning final withdrawal from the provident fund account shall be given effect to within two weeks, if it has not already been implemented. In case the amount has been released or adjusted, complete particulars of the payment or adjustment shall be furnished to the Petitioner.

8.6 If any amount is ultimately withheld, the Petitioner shall be furnished a reasoned statement specifying the amount withheld, the head from which it is withheld, and the statutory provision or recovery order relied upon.

All amounts found due and payable to the Petitioner upon completion of the reconciliation exercise shall be released within six weeks from today. In the event of default, the unpaid amount shall carry simple interest at the rate of 6% per annum from the expiry of the said period until the date of actual payment.
