The present writ petition has been filed by the petitioners, who are residents of Block-C, Acharya Niketan Road, Mayur Vihar Phase-1, New Delhi-110019 , seeking directions to the respondent/MCD to remove the illegal encroachment.

It is submitted that the petitioners have been facing encroachment and illegal activity in Block-C, Acharya Niketan Road, Mayur Vihar Phase-1, New Delhi-110019 , for the last three years, and the same is growing rapidly. 3. Counsel appearing on behalf of the petitioners submits that the various shopkeepers in the area in question, have encroached upon land outside their shops. Further, there are encroachments by other persons also, against which no action has been taken by the authorities, despite several

Status report has been filed on behalf of the respondent/MCD on 18^th November, 2025, wherein it is stated that action was taken by MCD on 17^th October, 2025, 12^th November, 2025 and 15^th November, 2025.

In light of the submission of the counsel for the petitioner that encroachments have surfaced again, the respondent/MCD was directed to file a fresh action taken report.

A fresh status report has been filed on behalf of the respondent/ MCD on 15^th April, 2026. Paragraph no. 4 of the said status report is set out below:

A status report has also been filed on behalf of the respondent no. 2/ Delhi Police, wherein it is stated that various FIRs have been registered for encroachment on public way in Acharya Niketan Marg and encroachment removal programs have also been conducted.

In light of the aforesaid stand taken in the status report(s), the present writ petition is disposed of, while directing the respondents no.3 and 4/MCD as well as respondent no.2/Delhi Police to conduct inspections of the area on

a regular basis and continue to remove illegal encroachments as and when found from Acharya Niketan Marg.

In the event the petitioners have any further grievance with regard to unauthorised construction, they are at liberty to take appropriate remedies in accordance with law.
