Pursuant to the order passed by this Court on 21^st August, 2026, the subject property has been inspected by the officials of Delhi Fire Service along with officials of BSES.

Status report has been handed over in Court by Delhi Fire Service and the same is taken on record.

As per the status report, the property is being used purely for residential purposes and the property comprises of Stilt, Ground, and three upper floors.

As per the petitioner, the height of the building is 17.45 mtrs.

No status report has been filed on behalf of the respondent no.1/BSES to contradict the same.

Therefore, in terms of the Delhi Electricity Regulatory Commission (Supply Code and Performance Standards) Regulations, 2017 (‘DERC Regulations’), the petitioner would be entitled to grant of electricity connection. The relevant extracts of the Schedule of Charges and the Procedure (Sixth Amendment) Order, 2021, dated 15^th April 2021, issued with regard to implementation of the abovesaid DERC Regulations, are set out below:

“ 4(1) In case the total height of such building is more than 15 meters without stilt parking and more than 17.5 meters with stilt parking, the distribution licensee shall:

(i) release the electricity connection in the dwelling units which are within the height of 15 meters without stilt parking and within the height of 17.5 meters with stilt parking of the building, without insisting for Fire Clearance Certificate :

(ii) in the dwelling units which are above the height of 15 meters without stilt parking and which are above the height of 17.5 meters with stilt parking of the building, the electricity connection shall not be provided unless the fire clearance certificate has been obtained:”

In view of the clear finding in the status report that there is a stilt floor in the subject building, and that the height of the subject building is less than 17.5 metres, a direction is issued to the respondent no.1/BSES to grant electricity connection to the petitioner, subject to fulfilment of codal formalities.
