The present petition has been filed by the petitioner stated to be engaged as a Multi Tasking Worker under the Directorate of Health Services and claims to be continuously working since 04.01.2020.

It is submitted that although the petitioner was discharging duties of a permanent and perennial nature, he was paid on a piece rate basis unlike regular counterparts who are paid on regular pay scales.

Aggrieved by non-regularization and disparity in wages, the petitioner raised an Industrial Dispute during the pendency of which, the respondent issued a termination notice dated 16.01.2026, prompting the present petition.

contravention of Section 33 of the Industrial Disputes Act, 1947.

Hence, the present petition has been filed seeking that appropriate directions be issued to the respondent to comply with the notice dated 09.12.2025 issued by the Conciliation Officer and in terms thereof, refrain from changing the service conditions during the pendency of the dispute, in violation of the Section 33 of the Industrial Disputes Act, 1947.

Learned counsel, as aforesaid, accepts notice on behalf of the respondent.

After some hearing, it is agreed that status quo, as on date, as regards the status of the employment of the petitioner shall be maintained and that before effectuating any termination, the respondent shall take permission of the concerned authority seized of the matter.
