respondents no.1 to 5 to demolish the unauthorised construction by the respondents no.6 and 7 on the property bearing no. 8-8, Khasra No. 215, Nafees Road, Joga Bai Extension, Batla House, New Delhi – 110025 .

The petitioner claims to be a co-owner of the subject property. It is stated that the private respondents no.6 and 7 have constructed a basement, ground, first, second, third and fourth floor and also encroached upon the government land. Photographs have been filed along with the writ petition showing the unauthorised construction.

Counsel appears on behalf of the respondent/MCD on advance notice and submits as follows:

i. Unauthorised construction in the form of basement, stilt, ground and first floor was booked on 24^th April, 2026 and a show cause notice was issued. Subsequently, a demolition order was passed on 1^st May, 2026. Pursuant to the demolition order, partial demolition action took place on 6^th July, 2026 and two RCC Panels were demolished.

ii. A communication dated 24^th April, 2026 has been sent to the SHO, P.S. Jamia Nagar for taking action against the unauthorised construction. A communication dated 24^th April, 2026 has also been sent to Delhi Jal Board as well as BSES Rajdhani Power Limited for disconnection of water and electricity connection respectively.

iii. Subsequently, another show cause notice has been issued on 6^th July, 2026 in respect of the unauthorised construction on the second and third floor. On 27^th July, 2026, a demolition order has also been passed in respect of unauthorised construction on the second and third floors.

have been handed over in Court and are taken on record.

Taking note of the aforesaid action taken by the respondents, the present writ petition is disposed of while directing the respondent/MCD to take action against the unauthorised construction in an expeditious manner. 6. The concerned SHO, P.S. Jamia Nagar shall provide the necessary police force to the MCD for the aforesaid purpose. The SHO shall ensure that no further construction is carried out in the subject building.
