This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-

“a) issue an appropriate writ, direction or order in the nature of certiorari praying for quashing of Impugned Letter No. No.F.12(27)/Affiliation(2023-24)/BTE/CD033726283/2700 dated 21.7.2023 issued by Respondent No. 1 (Annexure P-1);

b) issue an appropriate writ, direction or order in the nature of certiorari praying for quashing of the Impugned Letter

Enabled Services & Management with 40 intake capacity and to include the name of the Petitioner-Institute to the Respondent No.2 for counselling;...”

The petitioner’s counsel today submits that the respondent No. 1 has granted affiliation to the petitioner Institute on 16.03.2026, for the 2026-27 session, and hence the present petition has become infructuous, and seeks to withdraw the same.

It has also been urged by the Counsel for the petitioner that vide order dated 02.08.2023, this Hon'ble Court granted the interim stay of the impugned letter dated 21.07.2023, whereby the Application for extension of the petitioner’s Institute had been rejected. As a consequence thereto, the respondent No. 1 was directed to issue appropriate permission, enabling the petitioner institution to admit the students for the ongoing online counselling subject to the outcome of the instant petition. It is further stated by the learned counsel for the petitioner that the students have now completed the program and passed out from the petitioner Institute. Hence, their admissions may

kindly be regularised and he may be allowed to withdraw the petition. 4. On a query posed to the Counsel for the respondent No. 1, as to, whether they have any objection to the same, Mr. Rohatgi, learned counsel for the respondent No. 1, states on instructions that the respondent No. 1 has no objection if the admissions of the students that were admitted pursuant to the order dated 02.08.2023 are regularised.

Accordingly, the petition is disposed of and the admissions made by the petitioner Institute, pursuant to the order dated 02.08.2023 stands regularised.
