The present is a joint application under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 (“CPC”) for recording compromise and thereby disposal of the appeal, as settled.

It is submitted that during the pendency of the present appeal the parties have arrived at an amicable, lawful and voluntary settlement in respect of all disputes and claims forming the subject matter of the present appeal and suit, from which it arises.

It is submitted that in terms of the compromise between the parties, a Settlement Agreement dated 5^th August, 2025, has been executed between the appellant and the respondent, which has been filed on record along with

It is submitted that in terms of the Settlement Agreement, the appellant has agreed to pay to the respondent and the respondent has agreed to accept a sum of Rs. 1,00,000/- (Rupees One Lakh Only), in full and final settlement of all claims, rights, demands and contentions arising from or relating to the transaction in question and the subject matter of the suit and the present appeal.

Additionally, the respondent has agreed to withdraw and not to pursue any other civil or criminal proceedings, complaints, representations, or claims, whether pending or contemplated, against the appellant arising from or relating to the subject matter of the present litigation.

Further, the parties have agreed that upon the execution of the Settlement Agreement and compliance with its terms, no dispute, civil or criminal, shall survive between them, and neither party shall have any further claim against each other.

It is further submitted that the present compromise has been entered into freely and voluntarily by the parties, without any coercion, threat, undue influence, or misrepresentation. Thus, the present application has been filed.

Ms. Veena Arora, respondent appears in person.

She is identified by learned counsel appearing for the appellant.

The respondent, who appears in person, submits that she accepts the settlement out of her own freewill.

She has further accepted a sum of Rs. 1,00,000/- (Rupees One Lakh Only), by way of Demand Draft, that has been handed over by learned counsel appearing for the appellant to the respondent before this Court.

had deposited an amount of Rs. 4,00,000/- (Rupees Four Lakhs Only) before this Court, pursuant to the order dated 28^th May, 2010.

She submits that the said amount of Rs. 4,00,000/- (Rupees Four Lakhs Only), be released to the appellant accordingly. 14. Considering the settlement reached between the parties, it is directed that the sum of Rs. 4,00,000/- (Rupees Four Lakhs Only), as deposited by the appellant, along with interest, if any, that is accrued, shall be released in favour of the appellant.

For this purpose, the appellant or his authorized representative, shall file an appropriate application before the Registry.

The judgment and decree dated 22^nd February, 2010 passed by Additional District Judge, Tis Hazari Courts, Delhi, in Suit No. 772/2008 , is modified to the aforesaid extent.

Noting the aforesaid, the present appeal, along with the pending application, is disposed of, in terms of the aforesaid settlement.

The next date of 11^th September, 2025, stands cancelled.
