This petition is filed on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 (‘1996 Act’) seeking extension of the mandate of the learned Sole Arbitrator upto December, 2025.

Disputes having arisen between the parties, Petitioner filed a petition under Section 11(6) of 1996 Act in this Court, being ARB.P. 571/2022 for appointment of Arbitrator, which was allowed on 18.04.2023, appointing the Sole Arbitrator. On 06.12.2024, mandate of the Arbitrator was extended for six months with the consent of the parties, which expired on 14.05.2025. It is stated in the petition that the arbitral proceedings are at the stage of conclusion of final arguments by the parties and thus mandate be extended upto December, 2025 to enable the Arbitrator to conclude the proceedings

Ms. Iram Majid, learned Central Government Standing Counsel accepts notice on behalf of the Respondent and on instructions, submits that Respondent has no objection to the extension of mandate of the Arbitrator, but the extension may not be granted beyond two months. Counsel for the Petitioner, on the other hand, submits that the arbitral proceedings are at the stage of final arguments, but the Arbitrator has sought certain clarifications and therefore, time be granted upto December, 2025 for passing the award. 5. Accordingly, mandate of the Arbitrator is extended upto 31.12.2025 from 09.07.2025 and period between 15.05.2025 to 08.07.2025 is regularized.

Petition is allowed and disposed of in the aforesaid terms.
