is directly under control and supervision of Hamdard National Foundation through a sub-Committee as envisaged under a Family Settlement Deed (‘FSD’) dated 22.10.2019, as amended on 21.02.2020. Petitioners filed a petition under Section 9 of the 1996 Act seeking interim reliefs, which was disposed of vide order dated 20.09.2022 with certain directions and by the same order, with the consent of the parties, Court appointed a sole Arbitrator to adjudicate the disputes. It is stated in the petition that while the settlement talks were on going, the mandate of the Arbitrator extended by six months with the consent of the parties expired on 11.08.2024. In O.M.P.(MISC.) No. 28/2024, the mandate was extended for 6 months vide order dated 23.08.2024. Since no settlement took place, matter was fixed for arguments of the Claimants on their applications for 22.01.2025 and 06.02.2025. Counsel for the Claimants is stated to have commenced arguments on Section 17 applications on 22.01.2025.
