Apeejay School, Pitampura v. Charu Lata Mata & Anr.
Case brief
What is this about?
Division Bench (Navin Chawla and Mini Pushkarna, JJ.) of the Delhi High Court dismissed LPA 281/2025 filed by Apeejay School, Pitampura against the Single Judge's judgment dated 21.04.2025 in Writ Petition (Civil) No.14428 of 2022 (Charu Lata Matta v. Apeejay School & Anr.). The Single Judge had directed the school to compute the balance amount payable to respondent No.1 (calculation covering 01.01.2016 to 31.03.2022, net of amounts paid for 01.01.2016 to 31.03.2019), tender 25% of the balance with the computation, and liquidate the entire amount in four monthly instalments of 25% each, with a DoE verification mechanism if the employee disputed the calculation. The appellant contended that it had paid 7th CPC dues for 01.01.2016-31.03.2019 and from 01.04.2022 onwards, and sought relief from paying the interregnum arrears (01.04.2019 to 31.03.2022) owing to financial constraints, relying on the Supreme Court's interim order dated 02.01.2024 in SLP (C) Diary No. 48722/2023 (Greenfields Public School v. Anchla & Ors.) directing 25% arrears. The Bench held the admitted 7th CPC arrears were statutory dues owed since 01.04.2019, that adequate relief had already been granted through the instalment scheme, and refused further relief. Appeal and pending applications dismissed on 01.05.2025. Respondents appeared 'Nemo'.
