Counsel for the parties have handed over a ‘Draft Consent Terms Agreed to Between The Parties’ in Court , which has been signed by the counsel for the parties. The same are taken on record and are set out hereinbelow:-

“ DRAFT CONSENT TERMS AGREED TO BETWEEN THE PARTIES

Parties have settled their disputes on the following terms and conditions:

1. Respondent shall pay to the Petitioner a sum of 40,000 Euros towards full and final settlement of all amounts being claimed by the Petitioner pursuant to and under the Award dated 28.07.2022.

2. The sum of 40,000 Euros, being the Settlement Amount, shall be paid in the following manner:

(a) The sum of Rs.13 Lakhs deposited by the Respondent with the registry of this Hon'ble Court pursuant to the Orders dated 27.05.2024 and 30.08.2024, be released to the Petitioner.

(b) After converting the said sum of Rs.13 lakhs in Euros at the exchange rate of Rs. 102.7925 per Euro, which is the prevailing exchange rate as on 17.11.2025 per the Reserve Bank of India, the balance amount of 27,353 Euros shall be paid by the Respondent to the Petitioner in Euros through wire transfer in 24 equal instalments of 1139.71 Euros per month commencing from December 2025.

(c) The monthly instalment of 1139.71 Euro shall be paid on or before the 7th day of each month in the following Bank Account

3. Respondent agrees that in the event of any default in the payment of the Settlement Amount by the Respondent, within the above time frame of 24 months commencing from 07.12.2025, the full outstanding sum as claimed in the present Enforcement Petition in terms of final Award dated 28.07.2022 will become immediately due and payable.

4. On payment of the Settlement Amount, the liability of the Respondent under Loan Agreement No. PDGEU60863 dated 18.09.2017 and Award dated 28.07.2022 shall stand extinguished.

5. The present Enforcement Petition be disposed off in the above terms.”

The respondent, as well as authorised representatives of the petitioner, are present through video conferencing.

The parties shall remain bound by the aforesaid terms of settlement.

In view of the aforesaid settlement, the Registry is directed to release the sum of Rs. 13 lakhs deposited by the respondent along with the accrued interest, if any, in favour of the petitioner, as per the bank account details given above.
