This is a petition seeking setting aside the order dated 16.10.2024 passed by the learned Principal Judge, Family Court- Central, Tis Hazari Court, Delhi in MT. No. 256/2022 titled as “ Pooja & Anr. Vs. Mukesh @ Sanju ”.

It is stated by Mr. Vats, learned counsel for the petitioner that the learned Family Court has passed an ad-interim maintenance which is alien to the concept of Section 125 of Cr.P.C.

He states that in the present case, the affidavits of both the parties are already on record and the Family Court should have decided the application under Section 125 of Cr.P.C.

Mr. Vats, learned counsel for the petitioner states that rather than keeping the present petition pending, he would be satisfied if the learned Family Court is directed to hear and decide the application under Section 125
