Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( hereinafter referred to as ‘B.N.S.S. ‟) read with Section 482 of the Code of Criminal Procedure, 1973 ( hereinafter referred to as ‘Cr.PC’ ), has been filed on behalf of the Petitioners for quashing of FIR No. 0237/2022 under Section 323/354/452/506/509/34 of the Indian Penal Code, 1860 ( hereinafter referred to as ‘IPC ‟) registered at Police Station Najafgarh and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 14.12.2024.

On advance Notice, learned APP for the State has appeared and accepts the Notice on behalf of the State.

The Petitioner No. 1 is the husband of the sister of the Respondent No. 2/Complainant while Petitioner No. 2 is the brother of Petitioner No. 1. Essentially, it emerges that it is a matrimonial dispute between the parents, sister and the Petitioner No. 1, who is the son-in-law. The allegations in the Complaint are that the Complainant and her parents, brought their elder daughter, namely, Shalu, who is the wife of the Petitioner No. 1, without the knowledge of her husband. Thereafter, the Petitioners had forcibly entered into their room and have given beatings to the Complainant and the family members. It is further submitted that the sister of the Complainant, has been married to the Petitioner No. 1, for the last 15 years and is even now residing with him.

On the Complaint of the Respondent No.2/Complainant, FIR No.0237/2022 under Section 323/354/452/506/509/34 IPC, got registered at Police Station Najafgarh. On 16.08.2022, Charge Sheet under Section 173 of the Code of Criminal Procedure, 1973 was filed before the Metropolitan Magistrate, Dwarka Court. On 03.11.2022, the Petitioners were granted Bail.

Due to the intervention and efforts of friends, well-wishers and other respectable members of the society, the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Understanding dated 14.12.2024. In the Settlement, it was inter alia settled between the parties that they shall withdraw any Complaint filed against each other. It is also settled that the parties have decided to end all their disputes fully and to live peacefully.

Today, the Respondent No. 2, who is present in the Court, states that she has no objection if the said FIR is quashed.

The parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the background and the contents of the FIR and that the parties have settled the matter, the FIR No. 0237/2022 under Section 323/354/452/506/509/34 IPC, registered at Police Station Najafgarh and all the consequential proceedings emanating therefrom are quashed. 12. The Petition is disposed of accordingly.
