Quashing of FIR on matrimonial settlement — Petition under S.528 BNSS / S.482 Cr.P.C. by husband and his family members for quashing FIR No. 496/2019 under Sections 498A/406/34 IPC, P.S. Ranhola, District Outer, Delhi, arising from a marriage solemnized on 25.02.2012 that broke down on account of temperamental disputes. During pendency the parties settled their disputes before the Counselling Cell, Family Court vide written settlement dated 26.02.2024 (Annexure-P2); they dissolved the marriage by mutual consent and obtained a divorce decree dated 15.05.2025; petitioner no.1 paid the agreed lump sum of Rs.1,50,000/- towards streedhan, permanent alimony, dowry articles and maintenance (past, present and future), of which Rs.1,00,000/- was paid earlier and the balance Rs.50,000/- on the date of the order, receipt whereof respondent no.2 acknowledged in court. Respondent no.2 stated before the Court that she did not wish to prosecute the criminal proceedings any further and had no objection to the FIR being quashed. The present petition has been filed on behalf of the petitioners under Section 528 of BNSS /Section 482 Cr.P.C. seeking quashing of FIR No. 496/2019 under Sections 498A/406/34 IPC registered at P.S. Ranhola, District Outer, Delhi and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

They have been identified by Mr. Badam Singh, learned counsel for petitioners, Ms. Preeti, learned counsel for respondent no.2, as well as, by Investigating Officer IO/SI Banwari, PS-Ranhola

The brief facts of the case are that the marriage between petitioner no.1 and respondent no. 2 was solemnized on 25.02.2012 according to Hindu Rites and Customs. One male child was born out of the said wedlock, who is in the care and custody of respondent no.2. However, on account of temperamental issues, certain disputes arose between the parties and they started living separately. The dispute between the parties also led to the registration of the present FIR.

During pendency of the proceedings the parties have arrived at a settlement before the Counselling Cell, Family Court, terms whereof were reduced in writing in the form of settlement dated 26.02.2024, copy of which is annexed as Annexure-P2 to the present petition.

In terms of the said settlement, the parties decided to dissolve their marriage by filing a petition for divorce by way of mutual consent. Accordingly, petitioner no.1 and respondent no.2 have obtained decree of divorce dated 15.05.2025.

It is a term of the settlement between the parties that the petitioners shall pay a total sum of Rs.1,50,000/- to the respondent no.2 towards full and final settlement of all her claims on account of streedhan, permanent alimony, dowry articles, maintenance (past, present and future) etc. Out of which an amount of Rs.1,00,000/- has already been paid by petitioners to respondent no.2 in the manner stated in the settlement. Balance amount of Rs.50,000/- is stated to have been paid today.
