Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘B.N.S.S. ’) ( earlier under Section 482 of the Code of Criminal Procedure, 1973) (hereinafter referred to as ‘Cr.PC’ ), has been filed on behalf of the Petitioners, for quashing of FIR No. 0303/2022 dated 17.04.2022 under Section 308/34 of the Indian Penal Code, 1860 ( hereinafter referred to as ‘IPC’ ) registered at Police Station Vijay Vihar, North-West, Delhi and the Petition bearing No.W.P.(CRL) 3745/2024 under Section 528 of B.N.S.S. ( earlier Section 482 Cr.P.C .) has been filed on behalf of the Petitioners, for quashing of FIR No. 304/2022 under Section 308/34 of IPC, registered at Police Station Vijay Vihar and all the consequential proceedings emanating therefrom.

On advance Notice, learned ASC (Crl.) has appeared and accepted the Notice on behalf of the State.

The parties are neighbours and they had a fight in which, both the parties were injured. The incident is of 16.04.2022 and since then, they have been residing peacefully and there have been no fight inter se the parties.

On the Complaint of the Respondent No.2/Complainant, FIR No.0303/2022 dated 17.04.2022 under Section 308/34 of IPC, got registered at Police Station Vijay Vihar, North-West, Delhi.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them. The Affidavits of all the Parties are on record endorsing that they have amicably settled the disputes and have no objection if the quashing of the FIRs, is allowed.

the ground that Salman, Petitioner No. 1 in CRL. M.C. 8801/2024 has previous involvement and Gaurav and Bharat Gupta, Petitioner Nos. 2 and 3 in WP (CRL) 3745/2024, have also previous involvement and Salman is a bad character of the area.

Today, the Respondent Nos. 2, 3 and 4 are present in the Court and state that have no objection if the said FIRs are quashed. 9. The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 10. It is a neighbourhood fight, which had been taken place inter se the neighbourrs. They have amicably settled the matter and since then, they have been living peacefully. Bharat Gupta, Gaurav and Salman may have been a previous history but it is not a crime of the nature, which is against the State but pertaining to the fight inter se the parties. 11. Considering the nature of the allegations and that they have settled the matter, the FIR No. 0303/2022 dated 17.04.2022 under Section 308/34 of IPC, registered at Police Station Vijay Vihar, North-West, Delhi and CrossFIR No. 304/2022 under Section 308/34 of IPC registered at Police Station Vijay Vihar and all the consequential proceedings emanating therefrom are quashed.

The Petitions are disposed of accordingly.
